Terms of Service

General Terms and Conditions for the Webshop nduro.ch

1. Scope
These General Terms and Conditions (hereinafter "GTC") of the webshop NDURO apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the operator of the webshop (hereinafter "Provider") regarding the goods and/or services presented by the Provider in their webshop.

2. Conclusion of Contract
(2.1) The product presentations in the webshop do not constitute binding offers on the part of the Provider but serve as an invitation for the Customer to submit a binding offer.
(2.2) The Customer can submit the offer via the online order form integrated into the webshop. After placing the selected goods and/or services in the virtual shopping cart and completing the electronic ordering process, the Customer submits a legally binding offer for the goods and/or services contained in the shopping cart by clicking the button that concludes the ordering process.

3. Prices and Payment Conditions
(3.1) Unless otherwise stated in the product description, the prices shown include the applicable Swiss VAT (Value Added Tax). Shipping costs are shown separately at checkout, if applicable.
(3.2) The Customer is offered various payment options, which are specified in the Provider’s webshop.

4. Delivery and Shipping Conditions
(4.1) Unless otherwise agreed, the goods will be delivered to the delivery address provided by the Customer.

5. Retention of Title
The goods remain the property of the Provider until full payment has been received.

6. Warranty and Guarantees
(6.1) Statutory warranty rights apply.
(6.2) Warranty claims are valid only for new products and for a period of 24 months from the date of purchase.
(6.3) The handling of warranty claims generally follows a "bring-in" procedure. The Customer is required to contact NDURO in advance via email at support@nduro.ch before shipping a product to claim a warranty. The Customer must provide photos or videos of the damage or malfunction along with a copy of the invoice for evaluation.
(6.4) In the case of a legitimate warranty claim, the Provider will cover the shipping costs for the return of the item to NDURO. Unjustified returns may result in costs being charged to the Customer.
(6.5) The Provider covers the shipping costs for sending repaired or replaced goods back to the Customer.
(6.6) Warranty processing may take between 3 and 6 weeks. During this period, there is no entitlement to a replacement product or substitute delivery. However, NDURO may, at its discretion, offer a temporary solution on a goodwill basis.

7. Limitations of Liability
(7.1) Any liability for indirect or consequential damages is entirely excluded. Liability for direct damages is limited to the amount paid by the Customer for the respective service, product, or license.
(7.2) The Customer is obliged to report any potential damages to the Provider immediately. The Provider assumes no liability for auxiliary persons.

8. Special Provisions for Travel Services
(8.1) Specific terms and cancellation policies stated at the time of booking apply to travel services.
(8.2) The Provider is not liable for travel interruptions or cancellations due to force majeure.

9. Final Provisions
(9.1) The law of the country in which the Provider is based shall apply to all contracts between the Provider and the Customer.
(9.2) The place of jurisdiction for all disputes arising from or in connection with these GTC shall be Zürich, Switzerland, unless mandatory legal provisions stipulate otherwise.
